Terms of Service

These Terms of Service ("Terms") govern your use of Wilburn OneOS (the "Service") provided by Wilburn Enterprises LLC ("we", "us", "our"). By creating an account or continuing to use the Service, you agree to these Terms.
Eligibility & authority
You must be of legal age to enter into a contract. If you use the Service on behalf of an organisation, you represent that you have authority to bind that organisation.
The Service
Wilburn OneOS is an AI-assisted operations platform providing workspace, CRM, project, content, and automation tooling. AI outputs are drafts until you approve them; external actions (emails, payments, publishing, deletions) require explicit human approval.
Acceptable use
You will not:
- Use the Service for unlawful purposes, fraud, or spam.
- Infringe intellectual property, privacy, or publicity rights of others.
- Introduce malware or interfere with the Service's security, integrity, or availability (including probing, scanning, or unauthorised scraping).
- Use AI features to generate illegal content, deepfakes intended to deceive, hate speech, or attempts to jailbreak safety systems.
- Reverse engineer, resell, or redistribute the Service or circumvent technical limits.
You are responsible for your prompts, how you use outputs, verifying accuracy, and holding the rights necessary for content you submit. We may remove or restrict content, refuse or filter outputs, and suspend accounts to enforce these Terms. Rights-holders may submit takedown requests to privacy@wilburn.example; repeated infringement may result in termination.
Accounts & accuracy
You must provide accurate information, keep it up to date, and keep your credentials confidential. You are responsible for activity under your account.
Intellectual property
Wilburn Enterprises LLC and its licensors retain all right, title, and interest in and to the Service, including all software, documentation, branding, and related intellectual property. We grant you a limited, non-exclusive, non-transferable, revocable right to use the Service in accordance with your plan and these Terms. You retain ownership of the content you submit and grant us a limited licence to host and process that content solely to provide the Service.
Payment, subscriptions & taxes
Our order process is conducted by our online reseller Paddle.com. Paddle is the Merchant of Record for all our orders. Paddle provides all customer service inquiries for billing and handles returns. Payment, billing frequency, applicable taxes, renewals, cancellations, and refund mechanics are governed by Paddle's Buyer Terms, available at paddle.com/legal/checkout-buyer-terms. Our own Refund Policy is available at /legal/refund.
Accuracy of AI outputs
AI-generated outputs may be inaccurate, incomplete, or biased and are not a substitute for licensed accounting, tax, legal, credit, investment, medical, or other professional advice. Verify outputs before relying on them in regulated contexts.
Service level
We work to keep the Service available but do not guarantee that it will be uninterrupted or error-free. To the fullest extent permitted by law, all implied warranties (including merchantability and fitness for a particular purpose) are disclaimed.
Suspension & termination
We may suspend or terminate access, in whole or in part, for: (a) material breach of these Terms; (b) non-payment; (c) security, fraud, or abuse risk to the Service or other users; or (d) repeated or serious policy violations. You may cancel your subscription at any time through Paddle or your account settings. On termination, your right to use the Service ends and you may export data for up to 30 days, after which we may delete it.
Liability
To the fullest extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the fees you paid us in the 12 months preceding the claim. Neither party is liable for indirect, consequential, incidental, or special damages, including loss of profits, data, or goodwill. Nothing in these Terms limits liability for fraud, death, personal injury caused by negligence, or any liability that cannot be limited under applicable law.
Indemnity
You agree to indemnify Wilburn Enterprises LLC against third-party claims arising from your content, unlawful use of the Service, or breach of these Terms.
Governing law & disputes
These Terms are governed by the laws of the jurisdiction in which Wilburn Enterprises LLC is established, without regard to conflict-of-law rules. Disputes will be resolved in the competent courts of that jurisdiction, subject to any mandatory consumer-protection rights.
Changes, assignment & force majeure
We may update these Terms; material changes will be communicated in-product or by email. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. Neither party is liable for delays caused by events beyond its reasonable control.
